Medigap Guaranteed Issue Rights: Eligibility, Deadlines and Proof

Learn when federal Medigap protections may apply, how trial rights and state rules differ, and which documents to gather before changing coverage.

Medigap guaranteed issue rights protect the ability to buy specified supplemental coverage in certain situations. They are different from Medicare’s annual fall plan-election period. Having a chance to leave Medicare Advantage does not automatically guarantee acceptance into Medigap.

What a protected application means

When an applicable guaranteed issue right applies, the insurer must sell an eligible policy, cover pre-existing conditions and cannot charge more because of past or present health problems. The available policy letters and deadline depend on the event, your Medicare eligibility date and state rules.

Common federal situation Important limitation
Medicare Advantage leaves Medicare or your area, or you move outside its service area The protection applies when returning to Original Medicare and meeting the applicable event rules.
Employer, union or retiree coverage that pays after Medicare ends Keep the termination notice and confirm the latest applicable deadline.
You try Medicare Advantage for the first time and return within the protected trial period Rights differ depending on whether you joined when first eligible or previously dropped Medigap.
Your Medigap insurer fails or coverage ends through no fault of your own Document the loss and apply within the required period.

This table is not every possible protection. Medicare SELECT moves, certain significant network changes and insurer misconduct can also be relevant. Consult Medicare’s full event chart and your state insurance department.

Deadlines are short

Many protections allow application up to 60 days before coverage ends and no later than 63 days after, but the exact start and end depend on the event. Some deadlines use a termination notice or claim-denial date. Do not use a generic 63-day rule without checking your situation.

Trial rights generally concern the first 12 months in the qualifying arrangement. Returning to a former Medigap policy may depend on whether the same insurer still sells it. C and F restrictions apply to people newly eligible for Medicare on or after January 1, 2020; D or G may apply instead under the relevant right.

State rights and underwriting

States may provide broader protections, including for some people under 65. An online list of “guaranteed issue states” is not enough: check residency, timing, policy choices and whether the rule permits new enrollment or only a qualifying switch. Outside a protected period, medical underwriting can affect acceptance and price.

  1. Keep notices, envelopes, coverage dates and proof of the qualifying event.
  2. Ask the insurer to identify the right and deadline in writing.
  3. Confirm which policies are available under that right.
  4. Coordinate the start date before ending current coverage.
  5. Contact SHIP or the state insurance department if the application is disputed.
